Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GoMotion website and service at gomotionai.com (the "Service"), operated by IKERPRIME S.L. ("GoMotion", "we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service does

GoMotion turns a script or audio narration that you provide into an assembled video: an AI-generated or user-uploaded voiceover, stock and publicly available footage and images retrieved to match your script, captions, motion graphics and music. You preview the result, optionally edit it, and export a video file.

2. Accounts

• You must provide a valid email address and keep your credentials secure. You are responsible for all activity under your account.
• You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service.
• We may suspend or terminate accounts that violate these Terms, abuse the Service, or create risk for us or other users.

3. Credits, plans and payment

• The Service is billed through credits. Generating and exporting videos consumes credits based on video length and features. Current rates are shown before you confirm each generation.
• Subscriptions renew monthly and grant the plan's monthly credits. Unused credits remain available while your subscription is active. You can cancel anytime; access and credits remain until the end of the paid period. Cancellation stops future charges — it does not refund past ones.
• Payments are processed by Stripe; we never store your card details.
• If a generation fails on our side, its credits are automatically refunded to your balance.
• Prices may change with prior notice; changes apply from the next billing cycle.

4. Your content and copyright — your responsibility

• Your inputs. You represent and warrant that you own or have all necessary rights to every script, audio file, image or other material you upload or paste into the Service, and that none of it infringes any third party's rights (including copyright, trademark, privacy or publicity rights) or any applicable law.
• Assembled materials. The Service retrieves footage, images and other media from publicly available sources on the internet to visually match your script, and includes music tracks. The Service does not verify, license or clear rights on that material for you. Before publishing, monetizing or otherwise distributing any video produced with the Service, it is your sole responsibility to review it and to obtain any licenses, permissions or clearances required for the footage, images, music, trademarks, or persons appearing in it, in every territory where you publish.
• Your output, your risk. You assume all responsibility and liability arising from the use, publication, monetization or distribution of videos produced with the Service — including any copyright strikes, demonetization, takedowns, claims, damages or legal proceedings. IKERPRIME S.L. accepts no liability for third-party intellectual-property claims arising from content you produce or publish.
• Indemnification. You agree to indemnify, defend and hold harmless IKERPRIME S.L., its directors, employees and suppliers from any claim, damage, loss, cost or expense (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms — including any third-party copyright or other intellectual-property claim relating to videos you produced with the Service.
• Prohibited content. You may not use the Service to create content that is unlawful, defamatory, hateful, harassing, sexually explicit involving minors, deliberately misleading in a way likely to cause harm, or that infringes the rights of others. We may refuse, remove, or report such content.

5. Ownership

• As between you and us, you own the videos you export, subject always to the rights of third parties in materials included in them (see Section 4).
• We retain all rights in the Service itself — software, design, models, pipelines and branding. These Terms grant you no rights in the Service other than the right to use it.
• You grant us a limited license to host, process and store your inputs and outputs solely to operate the Service (e.g., generating, storing and letting you download your videos).

6. Content retention

• Generated projects (editable previews and their assets) are retained for a limited window — currently about 12 hours from the last save — and are then automatically deleted from our storage. Export your video to keep it.
• We may retain minimal transactional records (e.g., what was billed) as required for accounting and legal compliance.

7. Service availability — "as is"

• The Service is provided "as is" and "as available", without warranties of any kind, express or implied — including fitness for a particular purpose, non-infringement, availability, or that results will meet your expectations. Automated video assembly can produce imperfect results.
• We may modify, suspend or discontinue features at any time. We aim for high availability but do not guarantee uninterrupted operation.

8. Limitation of liability

To the maximum extent permitted by law, IKERPRIME S.L.'s total aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, loss of profits, revenue, data or goodwill — including consequences of publishing content produced with the Service. Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for willful misconduct or gross negligence).

9. Termination

You may stop using the Service and cancel your subscription at any time from your account. We may suspend or terminate your access for material breach of these Terms. Sections 4, 5, 8 and 10 survive termination.

10. Governing law and disputes

These Terms are governed by the laws of Spain. Any dispute shall be submitted to the courts of the registered domicile of IKERPRIME S.L., without prejudice to mandatory consumer-protection rules that may entitle you to the courts of your place of residence within the EU.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on the site or by email; continued use after the effective date constitutes acceptance.

Privacy Policy

We use no advertising trackers. The site stores your session tokens and a device identifier in your browser's local storage strictly to keep you signed in and to remember trusted devices. Payment pages are hosted by Stripe and subject to Stripe's own cookie policy.

We share data only with the processors needed to run the Service, under data-processing agreements:

Some providers process data outside the EEA; where they do, transfers rely on adequacy decisions or Standard Contractual Clauses. We never sell your personal data.

4. Retention

• Account data: while your account exists, then deleted or anonymized.
• Project content: ~12 hours from last save, then deleted automatically.
• Billing records: as long as required by Spanish accounting and tax law.
• Support messages: up to 2 years.

5. Your rights

You may exercise your rights of access, rectification, erasure, restriction, portability and objection at any time by emailing support@gomotionai.com from your account address. You may also lodge a complaint with the Spanish supervisory authority (AEPD, aepd.es).

6. Security

Passwords are stored with strong one-way hashing (PBKDF2), transport is TLS-encrypted end to end, sign-ins from new devices require email verification codes, and access to production systems is restricted. No system is 100% secure — if we ever detect a breach affecting your data we will notify you as required by law.

Purpose

This website provides access to GoMotion, an online video-generation service, under the Terms of Service above.

Intellectual property of the site

The design, code, text and graphics of this website and of the GoMotion application are the property of IKERPRIME S.L. or its licensors and are protected by intellectual-property law. Users' rights over the videos they produce are described in the Terms of Service.

Responsibility

IKERPRIME S.L. is not responsible for content generated by users with the Service nor for the use users make of it. Any user who publishes content produced with the Service does so under their own exclusive responsibility, as set out in the Terms of Service.

Applicable law

This legal notice is governed by Spanish law, including Law 34/2002 (LSSI-CE) and applicable consumer legislation.
